Guess Who Finally Got Indicted On Federal Firearms Charges?

In a complaint filed on September 6 with the United States District Court of Delaware, Special Prosecutor David Weiss indicated that he planned to file federal weapons charges against Hunter Biden – the son of President Joe Biden – by the end of the month.

After years of investigation, and after a plea agreement that was reneged on which Hunter Biden would have received broad immunity for federal firearms offenses, the Department of Justice has finally followed through with an official indictment.

According to an indictment filed by the federal court in Delaware, Biden was accused of lying when he purchased a gun in October 2018. At that time, he had admitted to struggling with crack cocaine addiction.

The son of President Joe Biden is also under investigation over his business dealings. The special counsel in charge of the case indicated that he could face charges in Washington, or California, where he resides.

The indictment is still sealed, but according to the Status Report submitted by the DOJ on Wednesday, they have charged Biden under Title 18, United States Code Sections (922(g)(3) and 924(a), which are listed below.

Section 922:

(g)It shall be unlawful for any person—

(1)
who has been convicted in any court of, a crime punishable by imprisonment for a term exceeding one year;
(2)
who is a fugitive from justice;
(3)
who is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802));

Section 924(a)

(2)

Whoever knowingly violates subsection (a)(6), (h), (i), (j), or (o) of section 922 shall be fined as provided in this title, imprisoned not more than 10 years, or both.
(The reference back to Section 922(a)(6) is as to making false statements in the attempt to acquire a firearm.)

Counts I & II allege Biden made a false statement in writing and certified it when he stated he wasn’t addicted to stimulants, narcotic drugs, or controlled substances in order to obtain the gun (a Colt Cobra 38SPL) in violation of Sections 922-a-6) and 924-a-2 (Count I), and Section 924-a-1(A)(Count II) in Title 18 of U.S. Code.

In Count III, Biden is accused of knowingly possessing the gun while he was a drug addict and illegal user of stimulants, narcotics, and controlled substances, in violation of Sections 922 (g)(3) of Title 18 U.S. Code and 924 (a)(2).
