Paul Pelosi Attacker’s Defense: Nancy’s ‘Official Duties’ Not a Factor

Over a year has passed since Paul Pelosi’s brutal attack, the husband of former House Speaker Nancy Pelosi. David DePape, caught on surveillance video entering the Napa home of the Pelosis and recorded by police bodycam footage, attacked Paul Pelosi using a hammer.

DePape has been charged with attempted murder and other federal and state crimes, including residential burglary, assault using a deadly weapon, and elder abuse. He was also accused of false imprisonment, elder abuse, and threats against a public official.

The federal trial started on Thursday. DePape could face a 50-year prison sentence if convicted. DePape has a history of drug abuse and mental illnesses, but his lawyer Jodi Linker remained firm in his not-guilty plea at his arraignment. Linker’s strategy is interesting, even though she didn’t use an insanity defense.

His defense attorney told the jury that he was involved in conspiracy when he entered Nancy Pelosi’s San Francisco house last year.

In the early morning hours of October 28, 2022, the attack on Paul Pelosi, then 82 years old, sent shockwaves throughout the political world days before the midterm elections last year.

Jodi Linker, the defense attorney, said that she will not dispute that David DePape assaulted Mr. Paul Pelosi. The encounter was captured on a police body camera video. She will instead argue that David DePape believed “with all of his beings” that he took action to stop corruption in government and abuse of children perpetrated by politicians and actors.

She said, “This isn’t a whodunit. But the government has failed to recognize the ‘whydunit’ in this case. And the why is important.”

DePape was a believer in right-wing conspiracies, which is why he attacked Paul Pelosi. Linker’s defense strategy seems to incorporate a phone call DePape placed to San Franciso station KTVU back in January.

This disturbing phone call shows that DePape was not only interested in the U.S. government but also in a worldwide conspiracy. Pelosi is just one of his targets. This call is very interesting because it was made following a concerted attempt by federal and state prosecutors in order to keep video footage, and certain facts, under wraps.

This is a very sensitive issue, and you’d expect that this would not be necessary if it were a clear crime. Editing or blurring out parts of the video can mitigate the argument that this is a public official and that sensitive or personal details may be revealed.

What would be the justification for preventing the sharing of 911 call recordings? Why is it that we cannot see the police interview of Depape on that night? The question becomes whether or not there is a cover-up, which will only create more speculation and curiosity. It is not a conspiracy theory to band together a large group of media outlets and get these details out.

Nancy Pelosi and the national media played out “Whydunit”, ad nauseam. Pelosi, then House Speaker, chose to make the attack a political hit on CNN less than a month before the midterm elections of 2022. We reported this at the time.

House Speaker Nancy Pelosi was interviewed by CNN’s Anderson Cooper 360 on Monday night. She discussed a range of topics, including the recent hammer assault on her husband Paul, and her future leadership of her party. She was very moving in her description of the pain and suffering that her family has endured since the attack, which is still unsolved. However, she did not waste time getting political, blaming Republicans who she believes incited the attacker, David DePape.

This play could have had a negative outcome if Nancy Pelosi’s Democrat majority was lost and she lost the House Speaker position. Linker’s continued claim that right-wing conspiracy theories are to blame lends credibility to Pelosi’s statement that “Republicans were out to get me” in order to further poison a well. In that case, Pelosi’s actions were successful. The trial will continue into the next week. Only time can tell what happens. DePape is certain to be found guilty of at least some of the charges, regardless of what defense he mounts. DePape has served the Left and Pelosi’s agenda well with the speedy federal trial.

News that Pelosi also tried to avoid a subpoena which may have been related to this case adds weight to their desire to simply put DePape away and forget about him.
