The House Oversight, Judiciary, and Ways and Means Committees identified a few grounds for referring Hunter Biden and James Biden criminally to the Department of Justice.
In a June 5th letter, the committees asked Attorney General Merrick G. Garland and Special Counsel David Weiss to refer Hunter to the criminal justice system for false statements made to Congress. (Weiss’ office is currently preparing to try Hunter on federal gun charges). These referrals are based on James’ February 21, transcribed interview, and Hunter’s deposition from February 28th.
The letter begins:
The Committees enclose to this letter a referral of criminal charges for Hunter Biden and James Biden under 18 U.S.C. SS 1001(false statements) and Hunter Biden, under 18 U.S.C. SS 1621 (perjury). The attached referral shows that Hunter Biden, James Biden, and their fathers made false statements about the impeachment investigation to the Oversight Committee, and to the Judiciary Committee, with the apparent intention of preventing the investigation from focusing on President Joe Biden.
The document outlines specific examples of Hunter’s false and misleading statements regarding his role and relationship with Rosemont Seneca Bohai, LLC, and his testimony about the infamous WhatsApp incident in which he allegedly threatened a Chinese associate while claiming his father was present.
The letter also asserts that Bobulinski…and Hunter have contradicted James’ “unambiguous” statements made during his interview, that Joe Biden had not met with Tony Bobulinski as a business associate in 2017.
The letter continued:
The evidence in the referral attached shows that Hunter Biden and James Biden gave materially false information to the Oversight Committee as well as the Judiciary Committee. These false statements are not lost on the Committees. Each instance implicates Joe Biden in the influence peddling of his family. Hunter Biden’s denial of his affiliation with Rosemont Seneca Bohai Bank Account obscures the account into which foreign individuals that met with Joe Biden sent funds. Hunter Biden’s creation of a fictional story in which he sent a threat to the incorrect individual is an apparent attempt to conceal the fact that Joe Biden was able to convince his Chinese partners to give him money. Hunter Biden also has to rethink his other statements about the event, including his claim that his father wasn’t sitting right next him at the time he sent out the message. James Biden denies that Joe Biden met Hunter Biden and Hunter Biden’s business associate Tony Bobulinski for a Chinese deal, despite being shown evidence and having multiple chances to change his answer. This appears to be an attempt by James Biden to shield Joe Biden from the fact that Joe Biden did meet with Hunter Biden’s family business associates.
The letter ends with the following:
When deciding whether or not to charge Hunter Biden for making false statements, the Department of Justice must consider his prior criminal activity. Hunter Biden had been federally indicted twice in different jurisdictions when he gave his Congressional testimony. He was also bound by two court orders that stated he couldn’t commit crimes while he was on federal supervised released.
I’m sure Merrick Garland and the DOJ will get this right.
