The conservative watchdog group urges both the Trump Administration and the State of Ohio to investigate Kenyon College. They claim that the college is violating the recently passed state bathroom law categorizing bathrooms by biological sex.
America First Legal wrote to Craig Trainor, the Department of Education acting assistant secretary for civil rights, and Ohio Attorney-General Dave Yost on Thursday, urging them to investigate the college.
Will Scolinos said that Ohio law was clear. Multi-occupancy bathrooms must be marked for men and women. The schools of Higher Education need to focus on education rather than forcing students into radical policies that force men and women to share restrooms. It’s not normal.
A spokesperson from the college stated, “Kenyon fully adheres to all federal and state laws.”
The spokesperson stated, “We are committed to making sure women at Kenyon do not face discrimination or any form of harassment, as we do with all the students, faculty and staff members who support them. We look forward to addressing any concerns that they might have with the Ohio Attorney-General’s Office and the Department of Education Civil Rights Office.”
Kenyon College has been accused of breaking Ohio Law by permitting multi-occupancy bathrooms in both its academic and administrative buildings. This was done to circumvent sex requirements. This law was passed in February and designates the student bathrooms, showers, locker rooms, etc., according to biological sex.
Kenyon’s policy update explains that its multi-occupancy administrative restrooms “cannot be designated exclusively for student use,” but students are allowed to “use these restrooms, if they so choose; however, the requirements outlined in the above section do not apply.”
AFL claims that Ohio law requires any restroom “accessible to more than one person at once” to adhere to entry restrictions based on gender.
In the letter, it is noted that many Ohio schools adhere to these rules by restricting all restrooms with multiple occupancy.
AFL claims that the policy is not in line with the executive order of President Donald Trump, which states, “Defending women from gender ideology extremism and restoring biological truth to the Federal Government.”
The letter from the AFL to DOE says: “The order states that the United States recognizes two sexes – male and female. ‘Sex’ is defined as an individual’s biological classification of male or female. It is not synonymous with and doesn’t include the concept of gender identity.”
The letter states: “Furthermore, Kenyon’s failure to provide separate restrooms for women and men in academic and administrative building appears to be a violation of Title IX.”
The Office for Civil Rights of the Department of Education is investigating Denver Public Schools, a school district, for possibly violating Title IX through installing all-gender, multi-stall restrooms.
Trainor stated in a press release that last month, “It is a brand new day for America and the OCR under President Trump will not tolerate any form of discrimination.”
Kenyon University, a private institution, has encouraged students who are affected by this new law to seek support from the civil rights office of the university, its college chaplains and campus security, the counseling center, and the Diversity Equity and Inclusion office.
Trump’s stated intention to dismantle the Department of Education and its workforce is already in place. This department will be a major battleground for the new administration as it tries to reverse Biden’s DEI policies and his woke policy.
The investigation also included 60 Universities due to the allegations of violence and antisemitism against Jewish students following the October 7, 2023, Hamas terror attacks on Israel.
