A federal judge has issued a preliminary injunction blocking a provision in recent legislation that would have denied Medicaid funding to Planned Parenthood and its affiliates. This development comes amidst ongoing debate over federal funding for organizations that provide abortion services.
U.S. District Judge Indira Talwani, presiding in Boston, ruled that the provision in question likely violates constitutional protections. The judge’s decision suggests that Congress may have improperly singled out Planned Parenthood for punitive action without due process.
The provision was part of the One Big Beautiful Bill Act, passed by the Republican-controlled Congress. It sought to withhold Medicaid funds from certain tax-exempt organizations and their affiliates if they continued to offer abortion services. The Department of Justice defended the law, characterizing it as a measure to prevent federal subsidies for abortion providers.
Judge Talwani, an appointee of the Obama administration, found that the law’s structure appeared to target all members of the Planned Parenthood Federation of America, even those not explicitly named. This specificity, she argued, may constitute an unconstitutional “bill of attainder” – a legislative act that inflicts punishment without a trial.
Planned Parenthood representatives claim that without Medicaid funding, nearly 200 of their health centers in 24 states could face closure. This raises important questions about access to various health services for Medicaid recipients.
