A federal judge has issued a preliminary injunction against an Arkansas law that would have required the display of the Ten Commandments in public schools. U.S. District Judge Timothy Brooks ruled that the law, known as Act 573, violates the First Amendment’s establishment and free exercise clauses.
The legislation, signed into law by Republican Governor Sarah Huckabee Sanders in April, mandated the display of the Ten Commandments and the U.S. motto “In God We Trust” in Arkansas classrooms and public buildings maintained with taxpayer funds. The law was set to take effect on Tuesday, but Judge Brooks’s ruling has halted its implementation.
This legal challenge follows a pattern seen in other states, including Louisiana and Texas, where similar laws have faced constitutional scrutiny. Judge Brooks, in his 36-page ruling, referenced a 1980 Supreme Court decision that struck down a comparable Kentucky statute, suggesting that the Arkansas law is “plainly unconstitutional” based on this precedent.
Proponents of the law, including Governor Sanders, argue that the Ten Commandments are foundational to Western law and morality. The legislation had broad support in the Republican-controlled General Assembly. Opponents, represented by civil liberties organizations, contend that the law violates the separation of church and state and imposes religious doctrine in public schools.
This raises important questions about the role of religious displays in public education and the interpretation of First Amendment protections. As similar cases unfold in other states, the courts’ decisions may have far-reaching implications for religious expression in public institutions across the nation.
