Settlements Reached for FBI Agents’ Who Were Disciplined for Invoking Personal and Political Views

The Justice Department has agreed to settlements with several current and former FBI agents who alleged they were unduly disciplined for expressing personal and political views. These views pertained to various topics, including the January 6th Capitol riot and the implementation of the COVID-19 vaccine mandate. Some agents also claimed they were reprimanded for disagreements with their superiors on investigative methodologies, according to their legal representatives.

Empower Oversight, a group established and managed by former members of Senator Chuck Grassley’s Republican staff, revealed resolutions for ten cases. This includes eight settlements reached in the last fortnight. Most cases involve agents who alleged that the FBI’s work was politicized during President Joe Biden’s tenure – an allegation that the FBI’s leadership has consistently refuted.

Three of these agents are slated to return to their duties at the FBI. Others are being allowed to retire voluntarily, while some are set to receive restoration of lost pay and benefits. The FBI has yet to respond to requests for comments, although FBI Director Kash Patel confirmed on social media previously that agreements had indeed been reached.

These settlements arrive amidst ongoing internal changes within the FBI under Patel’s leadership, including the reassignment and dismissal of experienced senior executives for reasons yet to be clarified. The FBI Agents Association has raised concerns that these terminations were executed without due process.

These settlements involved agents championed by Republican lawmakers as proof that the FBI under the Biden administration had become hostile to conservative viewpoints. This allegation was strongly denied by Patel’s predecessor, Chris Wray. In 2023, several of these agents testified before a special House committee investigating claims of the federal government’s “weaponization” against conservatives. Democrats dismissed the hearing as another partisan attempt to support former President Donald Trump.

Among those reinstated are Steve Friend, who claimed he was suspended and later resigned after refusing to participate in a SWAT team arrest of a January 6th suspect, and also objected to a COVID-19 vaccine mandate. Another is Garret O’Boyle, who voiced concerns about the FBI’s handling of investigations of January 6th, and Zachery Schoffstall, who alleged he was disciplined for voicing objections to the exclusion of potential exculpatory information during an investigation into a white nationalist hate group.

One of the ten settlements was reached last year with Marcus Allen, another FBI agent who had accused the bureau of politicization and later resigned after his security clearance was reinstated.
