President Donald Trump has signed an executive order directing federal prosecutors to pursue the death penalty in Washington, D.C., for certain criminal cases. This action comes despite the District’s 1981 repeal of capital punishment.
The order instructs the Attorney General and the U.S. Attorney for the District of Columbia to seek capital punishment “in all appropriate cases” where federal law permits and where, after thorough examination of evidence, “the applicable factors justify a sentence of death.” Additionally, it mandates that federal jurisdiction be pursued for all District cases where the death penalty is an option under federal law.
Washington, D.C., abolished the death penalty over four decades ago. However, as the nation’s capital, it falls under a unique jurisdictional structure that allows for federal intervention. President Trump recently federalized law enforcement in the District by assuming control of the Metropolitan Police Department, citing concerns over crime rates.
According to a White House fact sheet, Washington, D.C. had a homicide rate of 27.3 per 100,000 residents in 2024, placing it among the nation’s most dangerous cities. The President claims that his emergency order led to 12 days without homicides, though this order has since expired.
This raises important questions about the balance of local governance and federal authority in the District of Columbia, as well as the broader debate on capital punishment in the United States.
