A Biden-appointed federal judge has ordered the Trump administration to release approximately 615 illegal immigrants apprehended during immigration enforcement operations in Chicago, raising serious questions about judicial overreach and public safety.

U.S. District Judge Jeffrey Cummings ruled Wednesday that hundreds of detainees must receive bond hearings by November 21. The Department of Homeland Security must provide Cummings with a complete list of detainees by Friday.

The facts here are straightforward. Federal immigration authorities conducted lawful enforcement operations targeting individuals in the country illegally. These are not random sweeps. Immigration and Customs Enforcement routinely conducts surveillance and utilizes informants to verify targets before making arrests. Warrantless arrests have been standard operating procedure for federal immigration authorities for decades, as immigration violations are civil matters under federal jurisdiction.

Yet Cummings determined these arrests violated a consent decree in Illinois requiring officers to evaluate probable cause and flight risk before making arrests. This represents a fundamental misunderstanding of immigration enforcement authority and an alarming expansion of local judicial power over federal immigration policy.

The Department of Homeland Security responded forcefully to the ruling. “At every turn activist judges, sanctuary politicians, and violent rioters have actively tried to prevent our law enforcement officers from arresting and removing the worst of the worst,” Assistant Homeland Security Secretary Tricia McLaughlin stated. “Now an activist judge is putting the lives of Americans directly at risk by ordering 615 illegal aliens be released into the community.”

Diana Patricia Santillana Galeano allegedly fled a traffic stop in Chicago before running into a daycare to hide from federal agents. She crossed the border illegally in 2023 and had her children smuggled into the country last month. During her arrest, she attempted to lie about her identity and denied knowing the male driver in her vehicle, claiming she “just picked him up from a bus stop.”

Democratic Illinois Representative Mike Quigley deliberately misrepresented Galeano’s arrest, falsely claiming ICE snatched “a preschool teacher without a warrant in front of children” in his district. DHS quickly debunked this narrative. “Congressman, you are deliberately misrepresenting the facts,” the agency wrote. “ICE law enforcement did not target a daycare and were only at this location because the female illegal alien fled inside.”

This pattern of deception from elected officials combined with judicial activism creates a dangerous environment for law enforcement and American citizens alike.

The ruling stems from arguments by immigration advocates at the National Immigrant Justice Center, who claimed federal agents violated the Illinois consent decree during these arrests. Last month, Cummings ruled that warrantless arrests in Chicago violated the decree.
