Supreme Court Gets It Wrong on Birthright Citizenship and Trump’s Fighting Back

President Trump announced Wednesday he’ll ask the Supreme Court to reconsider what he’s calling an “absolutely insane” decision on birthright citizenship. And honestly, watching this unfold, it’s hard not to see his point. The court decided to uphold automatic citizenship for children born on American soil, even when their parents are here illegally or just passing through. Within hours, the consequences started materializing at our southern border.

Signs and billboards are already going up across Mexico and along the border advertising birthright citizenship services. Some reportedly list delivery prices starting at dollar amounts that would make your head spin. This isn’t speculation or fear mongering. It’s happening right now, in real time, exactly as critics of the ruling predicted.

Homeland Security Secretary Markwayne Mullin didn’t mince words about the decision. He called it “dead wrong” and pointed to something most Americans don’t think about enough: birth tourism. This practice, particularly common among Chinese nationals, involves foreign citizens traveling to the United States specifically to give birth here, securing American citizenship for their children while maintaining no real ties to our country. It’s a calculated exploitation of our system, and it poses genuine national security risks that the Supreme Court apparently decided to ignore.

You know what’s maddening about this? The Fourteenth Amendment was written after the Civil War to ensure former slaves received citizenship. It was never intended to create a loophole for foreign nationals to game the system. The framers of that amendment couldn’t have imagined international air travel, organized birth tourism industries, or the sophisticated networks that now exist to exploit this provision.

The economic angle matters too. When children born through birth tourism eventually return to claim their citizenship as adults, they can sponsor their parents for green cards. They get access to American universities at in-state tuition rates in some cases. They can work here without restriction. And their parents never paid a dime into the system or waited in any line. Meanwhile, people following the legal immigration process wait years, sometimes decades, to achieve what birth tourists accomplish with a plane ticket and a hospital stay.

Limited government doesn’t mean stupid government. Conservatives believe in protecting our borders and maintaining the integrity of citizenship. These aren’t radical positions. They’re common sense positions that most countries around the world already embrace. Canada amended their laws in 2009 to prevent exactly this kind of abuse. Australia did it even earlier. But apparently, America is supposed to just keep the door wide open while everyone else guards their sovereignty.

Trump’s decision to push back against this ruling shows the kind of leadership we need. The Supreme Court isn’t infallible. They’ve been wrong before, and they’re wrong now. Asking them to reconsider isn’t disrespecting the judiciary. It’s using the tools available within our constitutional system to correct a dangerous mistake before it causes irreparable harm to our national security and immigration system.

The border crisis just got worse, and it didn’t have to be this way.
