Houston Mayor Abandons ICE Cooperation Following Texas Democrat Sweep

Houston Mayor John Whitmire has reversed course on immigration enforcement cooperation, prohibiting city police from notifying Immigration and Customs Enforcement about illegal immigrants encountered during traffic stops or other nonviolent offenses. The timing is no coincidence. This reversal comes immediately after Texas swung blue for the first time in decades, with Democrat James Talarico flipping a Senate seat and Gina Hinojosa defeating incumbent Governor Greg Abbott.

The policy shift represents a dramatic about-face for Whitmire, who just months ago modified Houston’s sanctuary city policies under pressure from then-Governor Abbott, who threatened to withhold over $100 million in state funding. Now, with Democrats controlling the governor’s mansion and making significant legislative gains, Whitmire apparently feels emboldened to implement the restrictions city progressives originally demanded.

Under the new policy, Houston police will only contact ICE when illegal immigrants are charged with crimes serious enough to warrant jail time. Minor offenses, traffic violations, and other nonviolent encounters will result in no federal notification whatsoever. Whitmire justified this approach by claiming Abbott’s previous enforcement order caused "anxiety" among Houston residents. This reasoning is remarkable. The anxiety of law-abiding citizens about criminal illegal aliens apparently matters less than the discomfort some residents feel about immigration enforcement.

The Department of Homeland Security responded with barely concealed frustration, noting that seven of the ten safest American cities actively cooperate with ICE. The spokesperson highlighted recent Houston arrests of illegal immigrants convicted of serious crimes, including Alexander Montano of Cuba, convicted of willful homicide and burglary, Vietnamese national Ding Nguyen, also convicted of homicide, and Guatemalan national Julio Camey, convicted of sex offenses against a child. These are precisely the types of criminals who benefit when local authorities refuse to cooperate with federal immigration enforcement.

The facts are straightforward. When sanctuary city policies prevent local police from notifying ICE about illegal immigrants, federal agents must maintain a more visible presence in communities to locate and apprehend criminals that local jurisdictions release back onto the streets. This makes enforcement less efficient and potentially more confrontational.

Whitmire’s reversal exposes the political calculation at work. In March, he and Police Chief Noe Diaz implemented a policy requiring sergeant oversight when immigration warrants appeared in background checks, with subjects released if ICE could not arrive within thirty minutes. The Houston City Council approved related restrictions in April. But when Abbott threatened funding cuts and then-Attorney General Ken Paxton launched an investigation, Whitmire backed revisions. Now, with Democrats in power statewide, those threatened consequences have evaporated.

The broader context matters enormously. Texas has not elected a Democrat to statewide office since 1994, and its last Democratic governor was Ann Richards in the early 1990s. Talarico’s Senate victory represents the first Democratic win in that seat since Lloyd Bentsen in 1988. This blue wave fundamentally alters the political landscape, and Whitmire is responding accordingly.

The mayor claims his new policy represents "responsible" and "more effective" governance. But effectiveness must be measured by results. If the goal is public safety, the DHS spokesperson’s point about the safest cities cooperating with ICE is instructive. If the goal is political positioning in a newly blue Texas, then Whitmire’s reversal makes perfect sense. Houston residents will discover soon enough which goal their mayor truly prioritizes.
