Hunter Biden’s criminal lawyers, as reported by us on Thursday, claim that the failure to come to a plea deal with Hunter, and the filing of new charges against him, in California, is the result of a “selective” and “vindictive prosecution,” and shows a breach of separation of power. The defense team filed a motion similar to this in Delaware and will do so again in California. They also request an evidentiary procedure.
Abbe Lowell asked Leo Wise repeatedly during the California case conference and arraignment whether the prosecution had turned over all of their investigative material in the case. Wise replied that, to his knowledge, all potentially exculpatory materials had been given over. Lowell might have thought that certain negative information about this investigation wasn’t yet public.
FBI agents took pictures of the gun Hunter’s ex-girlfriend dumped in Delaware’s dumpster in 2018 in preparation for Hunter’s July court appearance. Delaware State Police seized the handgun and placed it in evidence. The FBI had the gun tested. Surprise, surprise! Surprise!

FBI investigators removed the sealed evidence in 2023 from the vault of state police to photograph the defendant’s gun. Based on their training and experience, they thought the substance to be cocaine. The investigators also thought that the evidence they had collected would confirm that the defendant purchased and used drugs during October 2018.
The Delaware State Police took the gun into evidence after the Delaware State Police responded to their request.
On the 12th of October 2018, a defendant went to a firearms shop in Wilmington, Delaware. After surveying the inventory, the defendant chose among other things:

On October 23, 2018, 11 days after it was discovered, the girlfriend of the defendant, who had been living with him at the time, found the gun in a brown leather pouch inside an unlocked, open car. The windows were down. The woman also found a box of ammunition and a Speed Loader. She left these items behind a grocery store in Wilmington, Delaware. A man who collects recyclables from trash cans discovered the gun, speed loader, and 23 rounds of ammo. The elderly man also found a brown leather bag. Later the police recovered the ammunition and gun case from the defendant. Also, the state authorities seized the speedloader and the brown leather pouch.
Hunter handled the cocaine and the gun alone at the time.
The prosecution responded to Hunter’s illogical and nonsensical claims with sarcasm, as it should. According to the prosecution, Hunter’s team has not been able to identify another similar person who was not prosecuted for committing the same crimes. They have also failed to present any evidence of racism.
In addition, the indictment was not approved by any of his “Truth Social” or politicians. Tweets by political opponents of President Obama didn’t lead current Executive Branch officials to seek an indictment against President Obama’s child.
