The Department of Justice recently informed the House Judiciary Committee of an ongoing internal investigation into allegations of misconduct within Special Counsel Jack Smith’s office. Jim Jordan, the chairman of the committee, was very critical about this briefing. It focused on ethical and accountability issues.
Sources familiar with the briefing claim that the investigation into Smith’s office began after a self-report was published in the middle of 2023. DOJ officials delayed any further investigation, citing Smith’s high-profile prosecutions against President-elect Donald Trump. Jordan was not happy with the DOJ’s approach and argued that delays like this could compromise the integrity of the investigation.
Smith’s team is accused of high-stakes, legal maneuvers which attracted media and judicial attention. One senior prosecutor from Smith’s team was accused of trying to influence legal counsel with inappropriate remarks made during a closed-door meeting. A second deputy was criticized for controversial sentencing suggestions in a politically charged case.
Jordan’s email to DOJ leadership was not only a way for him to express his frustrations, but it also served as an official demand that records and evidence be preserved. The Judiciary Committee is pursuing a deeper investigation into what they perceive as systemic ethical failures within the DOJ.
The letter said that the Committee was authorized by the Rules of the House of Representatives to oversee the Justice Department in order to inform possible legislative reforms. As stated previously, Congress has considered possible legislative reforms for the operation including proposals to remove OPR’s exclusive authority to examine allegations of ethical conduct levied by Department attorneys. Congress should re-examine the potential reforms because the Department and OPR have failed to provide detailed information.
The DOJ acknowledged Jordan’s letter but did not make any public comments. The DOJ is under increasing pressure from the GOP to maintain transparency and public trust during the investigation.
