Trump Applauds Appeals Court Over National Guard Power Ruling

President Donald Trump on Friday expressed his gratitude to an appeals court for their decision allowing him to maintain the deployment of the California National Guard in Los Angeles.

“The U.S. Court of Appeals for the 9th Circuit, late Thursday night, granted the motion for a stay of a ruling by U.S. District Judge Charles Breyer,” reports The Washington Post on Friday.

Judge Breyer had earlier in the day stated that the President had acted unlawfully by sending the California National Guard to Los Angeles in response to the protests against Immigration and Customs Enforcement actions. Breyer ruled that by dispatching the Guard, Trump had misbehaved, “both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Constitution.”

According to reliable sources, Breyer ordered President Trump to relinquish control of the troops to California Governor Gavin Newsom. The judge stayed his order until noon Friday; however, the government promptly filed a notice of appeal. The court quickly granted the motion for a stay and scheduled a hearing for Tuesday.

Breyer’s ruling came after California filed a lawsuit against Trump, Defense Secretary Pete Hegseth, and the Defense Department. The lawsuit aimed to restrict the National Guard and Marines to protecting only federal facilities and personnel in Los Angeles while limiting other activities. This raises important questions about the authority to deploy the National Guard and Marines in California without input or consent from the governor.

The court ruling has temporarily allowed the continued deployment of the National Guard in Los Angeles, a decision that has been recognized by President Trump. However, the legal battle over the scope of Presidential power and the rights of states remains far from over.
