A federal terrorism case against alleged Antifa militants who ambushed immigration agents in Texas has been derailed before it even started, thanks to a defense attorney who apparently thought jury selection was the appropriate venue for political theater.
United States District Judge Mark Pittman declared a mistrial on Tuesday during jury selection after defense attorney Marquetta Clayton showed up wearing a t-shirt plastered with civil rights figures underneath her blazer. Let us be clear about what happened here: this was not an accident. This was a calculated attempt to influence potential jurors in a case that has nothing to do with civil rights and everything to do with alleged domestic terrorism.
“I don’t know why in the world you would think that’s appropriate,” Judge Pittman told Clayton, expressing what should be obvious to anyone with basic understanding of courtroom decorum and legal ethics. The judge correctly noted that while he admired the civil rights figures depicted on the shirt, wearing such politically charged imagery during jury selection was as inappropriate as a prosecutor wearing an ICE pin or a shirt depicting Donald Trump riding an eagle.
“Politics — as prevalent as they are, as divided as they are — don’t have any business here,” Pittman stated. He is absolutely correct. The courtroom is supposed to be a place where facts and law determine outcomes, not where attorneys attempt to manipulate jurors through emotional appeals and political signaling.
The case itself involves serious allegations. On July 4 of last year, mask-wearing anarchists allegedly orchestrated an ambush at the Prairieland Detention Center in Alvarado, Texas. According to court documents, the attackers lured Immigration and Customs Enforcement agents outside by setting off fireworks. One alleged militant then yelled “Get to the rifles” before the group opened fire on unarmed correctional officers. A local police officer was shot in the neck area during the attack but survived.
The wounded officer managed to return fire despite being shot, while one attacker continued firing until his rifle jammed. The assailants then fled the scene, demonstrating the premeditated and cowardly nature of the attack.
This represents the Trump administration’s first terrorism case against Antifa, and it centers around a coordinated cell of nine defendants. Authorities initially arrested ten suspects, including former Marine Corps Reservist Benjamin Hanil Song, who allegedly fired shots during the ambush and evaded capture for a week. Five other individuals arrested in connection with the attack have already accepted plea deals and are expected to testify.
The facts of this case are straightforward: federal agents were allegedly targeted in a coordinated armed attack. This is domestic terrorism, plain and simple. The defense’s apparent strategy of injecting racial politics into a case about violent assault on law enforcement officers reveals either desperation or contempt for the judicial process.
Judge Pittman has indicated that Clayton will need to return to court at some point to determine whether she will face sanctions for her conduct. She was reportedly seen leaving the courthouse with her shirt turned inside out, suggesting she understood exactly what she had done wrong.
A new jury selection will begin Monday. One can only hope that all parties involved will remember that the courtroom exists to pursue justice based on facts and evidence, not to serve as a stage for political performance art. The victims of this alleged attack deserve better, and so does the American justice system.
