Wisconsin Sanctuary County Puts Ideology Above Victim Safety in Elderly Assault Case

There’s something profoundly broken when federal authorities have to beg local officials not to release an alleged sexual predator back onto the streets. Yet here we are, watching the Department of Homeland Security plead with Dane County, Wisconsin to keep Julio Cesar Morales-Jarquin behind bars after he was charged with two counts of second-degree sexual assault against an elderly victim.

Let that sink in for a moment. An elderly person, vulnerable and dependent on others for care, allegedly violated by someone entrusted with their wellbeing. And now sanctuary politicians are weighing whether their immigration ideology matters more than public safety.

Morales-Jarquin, a 31-year-old Nicaraguan national, worked at a residential care facility in Fitchburg when staff reported to police that he may have assaulted vulnerable residents. ICE issued a detainer request on April 27, a straightforward ask that local authorities hold him so federal immigration officers can take custody. It’s not complicated. It’s basic cooperation between law enforcement agencies, the kind that happens thousands of times daily across every other policy area you can imagine.

But Dane County operates as a sanctuary jurisdiction, meaning they’ve decided federal immigration law doesn’t deserve the same respect as other federal statutes. DHS officials revealed that the county has previously given ICE as little as 30 minutes to pick up individuals from their jail. Thirty minutes. That’s not cooperation. That’s theater designed to look compliant while ensuring failure.

You know what’s maddening about this? We’re not talking about someone who overstayed a visa and is otherwise living a peaceful life. We’re talking about someone accused of preying on the elderly, people who can’t defend themselves, people whose families trusted a care facility to protect them. The victims here aren’t abstract policy considerations. They’re real human beings who deserved safety and got betrayal instead.

The broader context makes this even worse. Secretary Markwayne Mullin has been sounding alarms about how the historic 76-day government shutdown left security agencies scrambling to recover, all while Democrats hold border funding hostage to appease their far-left base. Border security and immigration enforcement aren’t partisan issues, or at least they shouldn’t be. They’re fundamental government responsibilities, right up there with national defense and protecting citizens from harm.

Sanctuary policies emerged from a noble-sounding impulse about community trust and ensuring immigrants cooperate with local police without fearing deportation. Fine. But when that philosophy extends to shielding alleged violent criminals from federal authorities, it’s gone off the rails completely. There’s no universe where protecting someone accused of sexually assaulting elderly care facility residents serves any legitimate public interest.

What message does this send to other illegal immigrants who might consider committing crimes? What does it tell the families of victims? And honestly, what does it say about our priorities as a society when political posturing trumps protecting the most vulnerable among us?

Dane County officials face a choice that shouldn’t be difficult. Keep an accused predator in custody and let the justice system work, or release him and own whatever happens next. The detainer request isn’t asking them to violate anyone’s rights. It’s asking them to do what law enforcement agencies have done for generations when someone in their custody is wanted by another jurisdiction.

This case crystallizes everything wrong with sanctuary policies taken to their logical extreme. Reasonable people can disagree about immigration reform, border security measures, and the path forward for millions of undocumented people living productive lives here. But there’s no reasonable disagreement about whether someone accused of assaulting elderly victims should be protected from federal immigration authorities.

The answer is obvious. The only question is whether Dane County officials have the courage to choose victims over ideology.
