Jim Jordan Has Had Enough of the Virginia Prosecutor Who Considers Deportation Before Justice

Jim Jordan doesn’t mess around, and right now he’s got his sights set on a Virginia prosecutor who thinks checking someone’s immigration papers before deciding whether to charge them with a crime is somehow good policy. Let that sink in for a moment. Not their guilt or innocence. Not the severity of what they did. Their passport status.

Steve Descano runs the show in Fairfax County, Virginia, as the Commonwealth’s Attorney. He’s been there since January 2020, and apparently one of his first bright ideas was telling his prosecutors to “consider immigration consequences where possible” when cutting plea deals. Translation? If prosecuting someone might get them deported, maybe go easy on them. Never mind what they actually did or who they hurt.

You know what happened next? Exactly what anyone with common sense would predict. A man who entered the country illegally from Sierra Leone back in 2012 racked up more than 30 arrests. Thirty. The Department of Homeland Security confirmed it. And then 41-year-old Stephanie Minter, an American citizen, ended up stabbed to death. Her accused killer is that same man who apparently got chance after chance after chance.

Jordan chairs the House Judiciary Committee, and he’s investigating district attorneys in so-called sanctuary jurisdictions who’ve made immigration status part of their calculus when it has absolutely nothing to do with the crime at hand. He told reporters his committee will use subpoenas if these prosecutors don’t cooperate. There’s a process, he explained. Ask nicely first. Ask again. Work with their lawyers. But if they stonewall? The subpoenas come out.

Fairfax County operates as a sanctuary jurisdiction, which is bureaucrat-speak for “we don’t help federal immigration authorities even when we probably should.” Local law enforcement isn’t bound to cooperate with ICE. They can just look the other way while people who shouldn’t be here in the first place commit crime after crime after crime.

Jordan called it one of the dumbest policies he’s ever heard of, and honestly, that’s being charitable. You’re telling local cops not to work with federal law enforcement on enforcing federal law? What kind of backwards logic is that? It’s like telling firefighters they can’t coordinate with paramedics at the scene of an accident because jurisdictions.

Here’s where it gets even more interesting. Descano’s 2019 campaign for district attorney got a nice financial boost from the Justice and Public Safety PAC. You’ll never guess who backs that particular group. George Soros, the billionaire who’s made a hobby out of funding progressive prosecutors across the country who think the criminal justice system is too harsh on criminals. These DA’s pop up in city after city, promising reform and delivering chaos.

Fairfax County isn’t some random place in rural America. It’s a major suburb of Washington, D.C. Jordan pointed out that its proximity to the nation’s capital, the epicenter of national security operations, makes these sanctuary policies even more reckless. We’re talking about the backyard of the Pentagon, the CIA, the State Department. And local prosecutors are more worried about whether criminals might face deportation than whether they’re a danger to their neighbors.

The Department of Justice has opened its own investigation into Descano. That should tell you something. When even the DOJ under this administration decides your policies warrant scrutiny, you’ve probably crossed several lines.

There’s a broader principle at stake here beyond one prosecutor in one Virginia county. When district attorneys start factoring in irrelevant considerations like immigration status instead of focusing solely on guilt, innocence, and appropriate punishment, they’re not administering justice anymore. They’re playing social engineer. They’re substituting their political preferences for the law itself.

Stephanie Minter deserved better. She deserved prosecutors who would’ve thrown the book at her accused killer long before he ever had the chance to hurt her. She deserved a system that valued her safety over his legal status. She deserved leaders who understood that protecting American citizens comes first, not last.

Jordan and his committee are doing what should’ve been done years ago. They’re asking basic questions. Why are you considering immigration status when deciding whether to prosecute crimes? How many dangerous people have you released because you were worried about collateral consequences? How many victims paid the price for your ideology?

The answers better be good. Because Americans are tired of watching preventable tragedies unfold while prosecutors play politics with public safety. We’re tired of sanctuary policies that protect criminals instead of communities. And we’re especially tired of watching George Soros-funded district attorneys treat law enforcement like a social experiment instead of the serious responsibility it is.

If Descano and prosecutors like him won’t provide documents voluntarily, those subpoenas Jordan mentioned will start flying. As they should. The American people have a right to know what’s being done in their name and who’s being put at risk because of it.
