Biden’s DHS Let Millions of Visa Overstays Walk Free While Branding Them Non-Priority

The numbers don’t lie, even when politicians do. Between 2021 and 2024, Immigration and Customs Enforcement received more than 3.1 million leads on visa overstays. That’s not a typo. Three point one million foreign nationals who came here legally, promised to leave, and then simply didn’t. Among those leads, roughly 104,000 were flagged as potential threats to national security or public safety. You’d think that designation alone would warrant immediate action, wouldn’t you?

Instead, fewer than 500 of those leads were actually investigated. The number arrested? Eight. Not eight hundred. Not eighty. Eight human beings out of over 104,000 deemed potentially dangerous enough to merit special attention. The math here isn’t complicated, but the implications are staggering.

This comes from a new report by DHS Inspector General Joseph Cuffari, and honestly, it reads like a case study in deliberate negligence. The Biden administration issued a directive in September 2021 that essentially told ICE agents to focus only on “Priority 1” visa overstays. Everything else got shelved, forgotten, deprioritized into oblivion. The terminology matters here because calling someone “non-priority” is Washington speak for “we’re choosing not to care about this problem.”

Here’s where it gets worse. Even within that narrow Priority 1 category, which included fewer than 1,800 leads, ICE managed to investigate only 84 cases. Two arrests came from those investigations. Two. The rest of those potential threats? They’re still here, living among us, working jobs, moving through communities, while the federal government that’s supposed to protect American citizens decided they had better things to do.

Current DHS Secretary Markwayne Mullin called it what it is: dereliction of duty. The phrase carries weight because it’s not just about incompetence or bureaucratic inefficiency. This was policy. Former Secretary Alejandro Mayorkas and the Biden administration made a conscious choice to deprioritize enforcement, to tell agents their hands were tied, to let millions of people remain in a country they had no legal right to be in.

The Inspector General’s report also notes that ICE faced challenges verifying addresses and locating these foreign nationals. That’s a real operational problem, sure, but it’s also conveniently timed with a policy that told agents not to bother looking too hard in the first place. When you combine insufficient resources with directives that actively discourage enforcement, you get exactly what we got: a complete breakdown of immigration law.

And the numbers keep climbing. The latest visa overstay data from DHS shows almost half a million more foreign nationals overstayed their visas in Fiscal Year 2024 alone. That’s one year. We’re not talking about border crossings here, which dominate most immigration headlines. These are people who went through official channels, received temporary permission to enter, and then broke that agreement. The system depends on voluntary compliance and consequences for violations. Remove the consequences, and the system collapses.

There’s something particularly galling about visa overstays compared to other immigration violations. These individuals interacted with our government, submitted to background checks, made promises about their intentions. They looked American officials in the eye and lied. Not all of them, obviously, but enough to create a pipeline of illegal presence that dwarfs many other immigration challenges we face.

The Biden administration’s approach sent a clear message to the world: come here on a visa, overstay it, and we probably won’t come looking for you. Even if you’re flagged as a potential threat, your odds of facing consequences are statistically negligible. That’s not immigration policy. That’s immigration surrender dressed up in bureaucratic language about priorities and resource allocation.

Secretary Mullin promises the Trump administration will take a different approach, prioritizing American safety and actually enforcing the laws already on the books. Whether that happens remains to be seen, but the bar has been set remarkably low. Simply doing something would represent a massive improvement over the previous four years of deliberate inaction.

The real victims here aren’t abstract concepts or political talking points. They’re American citizens who trusted their government to maintain basic security protocols, to know who’s in the country and whether they belong here. Every community affected by crimes committed by visa overstays, every resource strained by illegal presence, every national security risk that went uninvestigated represents a failure of the most fundamental government responsibility: protecting its own people.

This wasn’t an accident. It was a choice.
