Biden’s Legally Dubious Scheme to Bypass Migration Caps

Title 42’s fate may be uncertain, but the Biden administration is planning to use a legally dubious strategy to bypass immigration caps without congressional approval. This could allow hundreds of thousands of Venezuelans to enter the United States, as well as Nicaraguans, Nicaraguans, and Haitians.

Alejandro Mayorkas, DHS Secretary said, “It was possible to create a legal pathway for individuals, so they don’t have the risk of crossing dangerous terrain with smugglers. This system would preemptively legalize immigrants without Congress’ consent.

Mark Krikorian (director of the Center for Immigration Studies), says that the Biden administration “is trying to change the way in which immigration policy is made without consulting Congress.”

“They are trying to see if they can get away with the kind of thing that the Executive [branch] got away with the [constitutional] war-making power,” Krikorian explained. “What they would like is to effect the same kind of de-facto constitutional change without having anybody actually vote on it.”

Barack Obama also sought to unilaterally alter immigration law to allow for an influx of immigrants. These policies have the ultimate goal to bring as many immigrants as possible into the United States for Democrats to pass mass amnesty and create millions of new Democrat voters.
