The situation in New Jersey’s U.S. Attorney’s Office is evolving, as reports indicate the current appointee’s term may be coming to an end.
U.S. Attorney Alina Habba has reportedly informed her staff that her tenure as federal prosecutor for New Jersey will conclude on Tuesday. This comes as her 120-day appointment by the Attorney General expires, and the state’s U.S. District Court judges prepare to meet on Monday to potentially vote on her replacement.
According to reliable sources, if no action is taken by the judges, First Assistant U.S. Attorney Desiree Grace would assume the role of acting U.S. attorney. The judges may also consider former U.S. District Court Judge Noel Lawrence as a candidate.
President Donald Trump nominated Habba, who previously served as one of his attorneys, for a full term on July 1. However, New Jersey’s Democratic Senators, Cory Booker and Andy Kim, have stated they will not support her appointment.
Habba has received endorsements from several national law enforcement organizations, including the National Troopers Coalition and the National Association of Police Organizations. These groups have commended her efforts in prosecuting gang and drug-related crimes.
The significance of this situation becomes clear when we consider the potential implications for New Jersey’s federal law enforcement leadership. If the judges vote to appoint a new U.S. attorney, only the President would have the authority to remove their choice. Alternatively, if no vote occurs, Grace could potentially serve as acting U.S. attorney for up to 210 days.
Senators Booker and Kim argue that New Jersey deserves a U.S. attorney with deep law enforcement experience and a non-partisan approach. Conversely, Habba’s supporters point to her endorsements from national police organizations as evidence of her qualifications.
As this story continues to unfold, it raises important questions about the balance between political appointments and the independence of federal prosecutors. The coming days may provide more clarity on the future leadership of New Jersey’s U.S. Attorney’s Office.
