Virginia County Uses Your Tax Dollars to Shield Illegal Immigrants From Federal Law

There’s a legal term that should be getting a lot more attention right now: alien harboring. It’s the federal crime of knowingly helping illegal immigrants remain in the United States. And if you squint just right at what Arlington County, Virginia is doing with taxpayer money, you start to see something that looks an awful lot like exactly that.

The county just approved a program that hands out grants to families whose breadwinners got picked up by ICE. We’re talking up to $2,000 per family, pulled from an initial pot of $50,000, distributed through a local ministry called ArlingtonThrive. The money covers basic needs and utilities. The Arlington County Board of Supervisors passed this 4-0, with one member absent, probably out buying irony repellent.

Here’s where it gets interesting. Former acting ICE Director Jonathan Fahey isn’t mincing words about what this really is. “Do you do anything to encourage or induce people to either come illegally or that are illegally here to stay?” he asked. “That could be arguably a violation of the alien harboring statute.” The logic tracks pretty cleanly. You give money to people who lost their illegal immigrant breadwinner. The reasonable conclusion? Those family members are likely illegal too. The money helps them stay. That’s the very definition of inducement.

Arlington County Manager Mark Schwartz gave the game away when he mentioned that many affected families are “unbanked.” That’s bureaucrat speak for people who can’t open bank accounts because they lack the identification that financial institutions require by law. You know who lacks that kind of identification? People who aren’t supposed to be here. “That shows the county knows the money is going to be going to people that are illegally here and it will help them stay,” Fahey said. It’s not subtle.

This is the same Arlington County whose board chairman, Democrat Matt de Ferranti, suggested back in January that residents call 911 to report ICE sightings. Think about that for a second. The chairman of a county board actively coaching citizens to interfere with federal immigration enforcement. He dressed it up in language about helping county officials know when ICE is present so they can “pursue Arlington County’s law enforcement mission,” but everyone understood the subtext. It was a warning system for illegal immigrants.

The context matters here too. This new grant program formed after ICE conducted a massive operation across Maryland and Virginia that netted 1,328 illegal immigrant arrests. One of those arrests involved Jose Mejia Hernandez, who ran from agents near the U.S. Air Force Memorial. He got tased, suffered a brain bleed, and suddenly five regional Democrats were falling over themselves to condemn ICE. Arlington County Police even launched an investigation into the encounter.

That investigation is pure theater. ICE has the authority to enforce immigration law. When someone runs, agents have the authority to stop them. But in the alternate reality that Arlington and its neighbors have constructed, federal immigration enforcement is somehow the villain.

De Ferranti told local press that the county is “valuing the families of those that have been displaced and removed.” Displaced. Removed. Notice the passive voice, the careful avoidance of any mention that these people broke federal law by being here illegally in the first place. It’s linguistic sleight of hand designed to reframe lawbreakers as victims.

The broader issue here goes beyond one county’s misguided compassion. When local governments actively work against federal immigration enforcement, they’re not just making a political statement. They’re creating real consequences. They’re telling people that if you come here illegally and set up shop in Arlington, the county will protect you. They’re advertising themselves as a sanctuary, even if they don’t use that exact word.

And they’re doing it with your money. That $50,000 comes from taxpayers, many of whom probably don’t appreciate funding what amounts to an incentive program for illegal immigration. The county can call it a humanitarian gesture all day long. That doesn’t change the underlying reality: they’re using public funds to help people remain in the country illegally after ICE removes the person supporting them.

Fahey called it “reckless disregard” for the law, and that’s being generous. This looks less like disregard and more like open defiance. Arlington County knows exactly what it’s doing. It’s choosing to prioritize its progressive credentials over federal law, betting that the political benefits outweigh any potential legal consequences.

The alien harboring statute exists for a reason. It’s meant to prevent exactly this kind of behavior, where state and local entities undermine federal immigration policy. Whether DOJ will actually pursue charges against Arlington County officials remains to be seen. But the fact that we’re even having this conversation tells you how far some localities have drifted from any reasonable interpretation of their role in the federal system.

You want to know what’s really happening here? It’s not complicated. Arlington County is spending taxpayer money to blunt the effects of ICE enforcement, hoping families will stay put instead of leaving when their breadwinner gets deported. That’s the goal. Everything else is just window dressing.
