Newsom Signs Controversial Wage Exemption Bill: What’s Inside AB610 ‘FAST Act’?

California Governor Gavin Newsom has signed AB610 into law. The FAST Act was signed into law in 2023 and will take effect on April 1st. The minimum wage in California will rise from $16/hour to $20/hour. This increase applies to all national fast-food chains with more than 60 locations. The FAST Act has caused a lot of protests, and not just because it dictates what small businesses are allowed to do.

It is important to note that this is not a complete list, as some donors and stakeholders were protected by non-disclosure agreements. This shows that the law was not worth the time and effort it took to write and sign.

California Assembly legislators passed a new set of exemptions for the new fast-food labor laws on Monday. The new laws have been controversial due to the secrecy surrounding their creation.

The new law in April will require that fast-food workers in California be paid at least $20 an hour. A state council will also set new standards for pay and worker protections.

The law approved by the legislature on Monday exempts all fast-food restaurants in airports, hotels, museums, casinos, and stadiums. They noted that the workers have already signed collective agreements with benefits and wages higher than the minimum wage set by the state for fast-food employees. After the bill has been signed by the Governor, the exemptions are immediately effective.

Chris Holden (a Democratic Assemblyman who sponsored the bill) said that in the Assembly, “we are trying not to stifle their ability to go beyond the compensation.”

SEIU International, like AB5, engineered the exemptions.

According to anonymous sources, who spoke to KCRA 3 on condition of anonymity about the incident that occurred Monday, SEIU used nondisclosure agreements to gain trust during a heated debate over how to proceed in the legislation. SEIU excluded other labor groups from final negotiations.

Three days before the end of the previous legislative session, the results of these negotiations had been made public. The public disclosure of these negotiations meant that other labor groups with collective bargaining agreements were not aware that they would have to comply with the law.

Bloomberg News reported that the Fast Food Accountability and Standards Recovery Act has a unique exemption for “chains which bake bread and sell it separately”.

California taxpayers can expect two things if they don’t do their work properly. The cost of fast food will rise dramatically. The money they spend will be used to defend the unconstitutional law. Assemblywoman Kate Sanchez is fighting for the repeal of AB5. AB5’s factors are still causing damage because they have been incorporated in the U.S. Department of Labor Independent Contractor Rule. The rule was not approved by the public but rather was implemented by a regulatory body. This rule destroys small businesses and independent professionals all over the country.
